Welcome to the Ron Smith and Co website terms and conditions. These terms and conditions apply to the use of our website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out below and our privacy policy.

Disclaimer

Whilst we have made every effort to ensure that the content of this website is as accurate as possible we do not guarantee the content will be free of errors. To the fullest extent permitted by law we shall not be liable for any kind of loss or damage from action taken or reliance placed on information contained on the site.

Orders

Any order for goods placed by you, the buyer through our website shall be subject to these terms and conditions. All other terms and conditions express or implied by statute or otherwise are excluded to the fullest extent permitted by law. Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under any applicable law or other statutory rights that may not be excluded. We must receive payment for the total price of the goods that you order before your order can be processed. Once payment has been received by us we will confirm that your order has been received by sending an email to you at the email address you provide in your order form. Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the goods ordered.

Delivery

Delivery is charged at £7.95 for all orders to UK mainland. We offer free local delivery to Worcester and Hereford, and free click and collect from either of our showrooms. Surcharges apply to delivery to remote location, Scottish Highlands, and Offshore, see our delivery page for more information.

Our delivery carriers are usually willing to leave items in a safe place if you are out. Please use the Comments box when ordering to specify a location, but note that we cannot be held responsible for any loss or damage to items as a result of being left unattended based on your instructions.

All the machinery we sell is brand new, but before delivery it will have been built up and fully tested, being subject to a Pre Delivery Inspection (PDI). This means there may be traces of oil or fuel, and  very minor signs of use on your machine, and it may not be in its original box. Items are often also repackaged to ensure safe delivery. Delivery Times

Delivery times are calculated in working days  i.e. Monday to Friday inclusive (working days do not include weekends or National Bank holidays). In case of Bank Holidays please allow an extra 2 working days. From the Receipt of your order we will endeavour to deliver your chosen items to you within 7 working days providing the goods are in stock, unless a longer delivery time is shown on the product information page. Deliveries to non- Mainland or remote locations may take longer. Risk in the goods will pass to you on delivery. Goods delivered by courier should arrive between 9am and 5pm, Monday to Friday. We do everything we can to meet the delivery time specified in this section, however occasionally delivery times may be affected by factors beyond our control and cannot be guaranteed. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. If the box is damaged please sign for it , clearly stating ‘received damaged’

Warranty

All products are covered by a full manufacturer’s warranty, the period of which varies according to the product. The warranty period starts from the date of purchase and some are conditional on the product being serviced at the recommended intervals by an approved dealer. The warranty covers faults, which may occur due to faulty components or workmanship but excludes consumable items, fair wear and tear or defects caused by misuse.

Liability

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email or in writing at our contact address within 7 days. If you notify a problem to us under this condition, our only obligation will be: To make good any shortage or non-delivery; To repair or replace any goods that are damaged or defective; or If repair to or replacement of the goods is not possible, or the cost of repair or replacement is disproportionate in the circumstances, to give you a partial or full refund for the goods in question, depending on what is reasonable in the circumstances. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage, or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation.

Security

Ron Smith and Co. work in partnership with Sage Pay to ensure all information you give us during the order process is encrypted before transmission via the World Wide Web. Privacy

We are committed to protecting your privacy. We will only use the information that you provide only for the purpose of processing your order or enquiry and evaluating our performance. Your name, address and telephone number will be provided to our courier to allow them to deliver your order. Where it is necessary to validate the warranty on your purchase we may complete and submit the registration details on your behalf. Typically this would involve supplying your name, address, telephone number and details of the equipment purchased to the manufacturer of the equipment or the manufacturer’s UK representative of the manufacturer if not UK based. We also share customer order information with Trustpilot, so that we can evaluate our performance and collect customer reviews. For more information on this, please see our Privacy Policy. Except as already mentioned, we will not provide your personal details to others.

Price information

The prices shown are only applicable to purchases made via the Ron Smith and Co Website. Prices in our stores may vary to those shown on the website. Special offers and promotions advertised in the press or other media may be excluded unless specifically advertised as available online. All prices are correct at time of display online and include V.A.T where appropriate. We regret we are not able to offer VAT exclusive pricing for deliveries to the Channel Islands. In the unlikely event of an administrative error resulting in an incorrect price being displayed, we reserve the right to correct the price. In these circumstances, you will not be bound to continue with your purchase, and will be asked to email us to confirm that you wish to proceed.

Cancellation of contract

You may cancel your contract with us for the goods you order at any time up to the end of the fourteenth day from the date you receive the ordered goods, which must be in writing or by e-mail. If you have received the goods before you cancel your contract then, you must send the goods back unused and in their original packaging to the address specified by us, at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at the address specified by us, at your own cost and risk as soon as possible. Once you have notified us that you are cancelling your contract, any sum deducted by us for the products from your credit card, will be re-credited to your account as soon as possible provided that the goods in question are returned by you in the condition they were in when delivered to you, and within fourteen days of notifying us of the return. We regret that delivery charges where applicable are non-refundable. If you do not return the goods or pay the cost of return delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

Returns

Where goods are not faulty but the customer wishes to return them, the goods can only be returned to the company if fully re-saleable, being unopened with any original manufacturers seals or shrink wrap in place, within fourteen days. Such returns will be subject to a restocking charge of 25% of the original purchase price. You will be under a duty to take reasonable care to see that returned goods are well packaged, so to avoid damage in transit. An appropriate method of return should be used. All goods are returned at your own cost. When returning any petrol powered product all oil and petrol MUST be drained from the engine before you release the goods to a carrier. This is for the safety of the carrier firm.

Cancellation by us

We reserve the right to cancel the contract between us if:

  • We have insufficient stock to deliver the goods you have ordered
  • The product is no longer available due to manufacturers non supply
  • We do not deliver to your area
  • One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment.
